Hi all. This is probably a question for tremont. If a person has suffered ADHD all their life without knowing it until recently, and took on financial liabilities before being diagnosed, are they legally responsible and would any agreements be null & void because of the condition? I ask this with the fact in mind that ADDers are very well documented to be irresponsible with their money. Regards. mediaseller

I can't see why this would be an issue - everyone has control of their finances unless they have them removed or surrender them.

I very much doubt that. Just about everyone would be running to their doctors for diagnosis if that were the case. i did have some issues with HSBC a few years back and, as they could see how the adhd comlicated matters they agreed they would only extend my overdraft with my dad's authority. In reality, this never happened and i have been able to extend it but just accept that whatever i borrow i have to pay back same as everyone else does. If you've had any bank charges or forced payment protection policies it is well worth going about claiming them back though, there are some template letters on www.moneysavingexpert.comwhich are really useful... Im bumping this because I now find myself in a position where I am arguing with my bank, emmm well they are charging me and im complaining loudly. Im going to report them to the Ombusman for it, I did already with the same stunt previously and I got my money back.
Im waiting on the FSA calling me back to give me some info but anything that could help in this matter would be great.
Can I demand my bank provides accomodations for me? lol, i love demanding things. My bank should be doing this anyway but is there a legal requirement for THEM to provide reasonable adjustment. I like that term as well btw.
It would be good to try and get the bank to develop some sort of relationship with me. I know that was back in the dark ages but I sorely need it. At the moment THEY are my sworn enemies and I absolutely detest THEM but now I realise Ive been getting unfairly punished and THEY should be trying to help me with things like this rather than fining me all the time.
Im a bit peeved btw ;D

Madscott, the only issues we have been involved with is with ADHD young people and mobile phone contracts---running up huge debts with call/internet charges and managed to have these wavered when the debt recovery company mails them.
We have clearly informed the company that the young person in question has disabilities and that when contracts were signed in phone shops, there was no appropriate adult in which to provide guidance or explain the small print in the contract and that there was nothing on the application that referred to disability. So from this the bill has been cleared and noted for further possible contracts.
We are now communicationg with a leading mobile phone company and working with them to put something together that provides information in easy to understand format. Many of the youngsters (16-25) we work with have parents or carers that are now appointees and who deal with their finances of benefits, meaning the bank accounts are in joint names and no direct debit payments can be made without two signatures, so this has assisted us to have contracts terminated without charge.
We like to think that all young people with ADHD be given the right to choice, but when they dont understand the consequences of their actions they clearly need guidance and support to help them make the correct choice!
All I would suggest you do is ask your bank as to what their policies are with regards to customers with disabilities (hidden impairments) as this usually sends alarm bells ringing and they become more relaxed in putting a payment plan together that suits you.

Just had this amazing chat with my mortgage providor and they are now starting to see sense after about 5 email this week and several chats. I was almost in tears when i was on the phone today and it was really strange. I was going off on one and starting to tell them they had a legal requirement to provide some reasonable adjustment in relation to my problems and that I was waiting on a call back from both the FSA and the Equality and Human Rights Commission. I was feeling weird cos the anger was not so ferocious (im on the meds) and I was beginning to feel like giving up and in general just teary through utter frustration. Thats a new one for me btw, normally the anger just builds.
Very soon after I started to talk about codes of practice and legal requirements they decided they would refund my fine and move my due date to give me a little time. They said there system is automated but if it happens again ive to phone them and they will "most likely" remove it.
I was asking them what they do for their other customers as I cant be the only one with problems, nothing. Ah well, at least they fixed my problem for the moment. I still dont like them though ;D

i wrote to my housing association so much because the house had many, many repairs and they took along time to get started on them, i included drs notes, health visitor letters (because we had bad damp among other things, i kept writing and ringing (sporadically over a year) and eventually i think they got fed up with me and ive had, a new kitchen, damp proof course, full double glazing, and the downstairs replasterd, i also write letters for other people to get tax back, complain about services, bank charges, wrongly charged things... i love it and you nearly always get good results because not alot of people can be bothered. ive even took dead golfish and hamsters back to the shops because they didnt live very long and got my money back for the fish and a replacement hamster! they couldnt really refuse as i took the dead hamster with me to the shop and gave it them back ;D and took back the fish, unfortunately it had died on the saturday of a bank holiday weekend so when i did get it back to the shop on tuesday it didnt smell or look too good

Backing up what Honey said - I've been involved in helping out vulnerable people out who have overstepped financial boundaries. A lot of companies/organisations will play ball if you lean on them a bit on the penalty clauses. You do hear of mobile phone providers doing serial sales to known vulnerable people but once they have been taken to task they always collapse and refund - but you know that some of the sales people know what they are doing and carry on regardless.

Where do you even start when trying to get a bank to help you. I was trying to tell them about my difficulties and its near impossible to get someone who hasnt a clue to understand how I cant just remember etc. So I forget, tough titties. They dont seem to grasp the situation at all.
How do I explain this stuff to the bank?

you could send them some info on ad/hd maybe highlighting the symptoms that cause problems with financial things. if they actually read it they might be able to understand a bit better, i always find writing letters easier than phone calls, i always cry when im angry so find it hard to get my point across. i always get call centres in india or whereever when i ring aswell so they cant even understand what im saying nevermind mental health problems!
